By using Umka the user (hereinafter the “user”) confirms to have read and understood these terms of use and agrees to them.
Umka is made available to the User free of charge. Some features of Umka, however, may only be available via subscription or purchase with costs.
Umka is provided via App Stores and their associated infrastructure. The User shall use such App Stores independent from Umka and the respective Terms of Use shall apply.
With regard to user content subject to intellectual property rights, the User shall expressly grant Umka a royalty-free, sublicensable, non-exclusive and worldwide license to use such content in connection with Umka subject to mandatory legal provisions.
The User shall not be legally entitled to use Umka. Umka may discontinue its providing of Umka App or exclude the User from using Umka at any time without stating any reasons. Umka may change Umka App at any time without stating any reasons, in particular with regard to paid functionalities, if any.
Subject to mandatory legal provisions, Umka. shall not assume any liability for direct or indirect damage caused by the use of Umka or in connection with Umka. In the case of violations of these terms of use and in the case of violation of rights and corresponding claims of third parties, the User shall expressly indemnify Umka from any liability and shall be liable for damages vis-à-vis Umka to the full extent.
Umka may change these terms of use at any time. The User will be informed about such changes in a suitable manner. The User may discontinue the use of Umka at any time. By continuing the use of Umka after changes of these terms of use have been notified, the User shall expressly consent to such changes. Subject to mandatory legal provisions, the use of Umka App shall be exclusively governed by Umka being the exclusive place of jurisdiction.
If you subscribed for an Umka App, you may cancel your subscription at any time. All cancellations will take effect starting at the end of the current billing period. For example, if you have a monthly subscription that began on the first of the month but cancel mid-month, your cancellation will be effective as of the end of that month. Sorry-- there are no refunds on paid subscriptions once the charge has gone through for the billing period.
Paid subscriptions to the Umka App are auto-renewing. You will be charged the stated subscription amount for the subscription period upon completion of your registration and submission of your payment information. You hereby agree to and authorize automatic (recurring) billing, and you agree to pay the charges made to your account in connection therewith. You will be billed at the then-current applicable subscription price plus any applicable taxes. Payments for renewal subscriptions are processed using the same billing cycle as your current subscription. Subscription fees may change at any time, to the fullest extent permitted under applicable law. Your subscription, and monthly billing of your account, will continue indefinitely until cancelled by you in accordance with the Cancellation section of this Agreement.
